Terms of Service
These Terms of Service ("Terms") govern every purchase made on Byourself.es (the "Site"). By placing an order, you confirm that you have read, understood, and accept these Terms in full. If you are contracting as a consumer, nothing in these Terms limits any mandatory right you have under the law of your country of residence — where a conflict exists, your mandatory statutory rights take precedence.
1. Definitions
"We"/"us"/"our" refers to the operator of Byourself.es identified in Section 2. "You"/"buyer" refers to the person placing an order on the Site. "Consumer" means a natural person acting for purposes outside their trade, business, craft, or profession, as defined under EU consumer protection law.
2. Who we are
Byourself.es is operated by Iryna Burman ("we", "us", "our"). For any question, correspondence, or formal notice — including complaints — please use the Contact page.
3. Eligibility
By placing an order, you confirm that you are at least 18 years old, or are placing the order with the involvement of a parent or legal guardian, and that you have the legal capacity to enter into a binding contract.
4. Products and pricing
All products are sourced from authorized distributors and wholesale suppliers — see our Authenticity Guarantee. Prices displayed on the Site are shown in the currency applicable to your region and include all applicable taxes (VAT), unless stated otherwise. Delivery costs, where applicable, are shown separately before you complete your order. We reserve the right to correct pricing or description errors before an order is confirmed; if a pricing error is discovered after payment, we will contact you with the option to reconfirm at the correct price or cancel with a full refund.
5. How a contract is formed
Adding an item to your cart is not an offer to purchase. Your order becomes a binding offer once you complete checkout and payment is authorized. We accept your offer, and a contract is formed, at the point we confirm the order by email. We may decline or cancel an order — for example if an item is unexpectedly out of stock, if payment cannot be verified, or if the details provided appear inaccurate — in which case any payment taken will be refunded in full without delay.
6. Payment
Payment is taken by card at checkout through our payment processor. We do not store your full card details. Your order will not be dispatched until payment has been successfully authorized.
7. Shipping and delivery
Shipping methods, costs, and estimated timelines are listed on the Shipping & Payment page. Delivery dates are estimates, not guaranteed deadlines, unless expressly agreed otherwise in writing. Risk in the goods passes to you once the order is delivered to the address you provided.
8. Right of withdrawal and returns
If you are a consumer, you benefit from the statutory 14-day right of withdrawal under EU distance-selling rules, with no reason required, running from the day you (or a third party you designate) take physical possession of the goods. To exercise this right, simply inform us via the Contact page, or use the process described on our Returns & Exchanges page — a clear statement of your decision to withdraw is sufficient; a specific form is not required. Full conditions, timing, and the return process are set out on that page, which forms part of these Terms.
9. Legal guarantee of conformity
Independently of our own returns policy, all goods sold to consumers in the EU are covered by the statutory legal guarantee of conformity (currently a minimum 2-year period from delivery under Directive (EU) 2019/771, or the longer period required by your country of residence if applicable). If a product is faulty or does not conform to its description, you are entitled to a repair, replacement, price reduction, or termination of the contract as provided by the applicable law of your country of residence, at no cost to you. This guarantee exists regardless of, and is not limited by, our voluntary returns policy above. To make a claim, contact us via the Contact page with your order number and a description of the issue.
10. Complaints handling
If you have a complaint about your order or about these Terms, please contact us via the Contact page with your order number and a description of the issue. We aim to acknowledge complaints promptly and to resolve them fairly and without unreasonable delay. If we are unable to resolve a complaint to your satisfaction, you may refer it to the body identified in Section 13.
11. Liability
Nothing in these Terms excludes or limits our liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation. Subject to that, we are not liable for indirect or consequential losses, or for damage resulting from improper use of products purchased on the Site.
12. Intellectual property
All content on this Site — including text, images, graphics, and the Byourself.es name and branding — is protected by intellectual property rights and may not be reproduced or used without our prior written consent, except for personal, non-commercial use. All third-party trademarks (including brand names and logos of the designers and manufacturers whose products we sell) remain the property of their respective owners.
13. Governing law and disputes
These Terms are governed by the applicable consumer protection laws of the European Union and of your country of residence, which take precedence over any conflicting provision. If you are unhappy with how we've resolved a complaint, you may refer your case to your national consumer dispute resolution / alternative dispute resolution (ADR) body, or to the courts of your country of residence, where this is required by mandatory consumer protection law. Note: the European Commission's online ODR platform was permanently discontinued as of July 2025 and is no longer available — please contact your national consumer protection authority or ADR body directly instead.
14. Force majeure
We are not liable for any delay or failure to perform our obligations where this is caused by circumstances beyond our reasonable control, including but not limited to acts of war, natural disaster, strikes, or disruption to our suppliers' or carriers' operations.
15. Severability
If any provision of these Terms is found by a court or authority to be invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
16. Entire agreement
These Terms, together with our Returns & Exchanges, Shipping & Payment, and Privacy Policy pages, constitute the entire agreement between you and us regarding your purchase, and supersede any prior understanding relating to the same subject matter.
17. Changes to these Terms
We may update these Terms from time to time to reflect changes in our practices or in applicable law. The version in effect at the time you place an order will apply to that order. Material changes will be reflected by an updated publish date on this page.
